These terms apply when you use the Celby website or services. By using the site, enquiring about a property, or listing your home with Celby, you agree to them.
What Celby is — and isn't
Celby is a platform that gives homeowners the tools, marketing and support to sell their homes privately. Celby is not a real estate agency and does not act as an agent for any buyer or seller. Every home on Celby is sold by its owner. Negotiations, agreements and decisions happen directly between buyer and seller.
No advice
Nothing on this site is legal, financial or professional advice. Buying or selling a home is a significant transaction: both buyers and sellers should use their own lawyer and do their own due diligence before signing anything. Sale and purchase agreements only become binding when signed by both parties, normally through their lawyers.
Listings and content
Listing information is provided by the property owner. While we encourage accuracy, Celby does not verify and does not guarantee any listing information, and is not responsible for errors or omissions in it. Buyers must satisfy themselves about a property through their own enquiries, inspections and professional advice.
Fees
Celby charges home sellers a flat fee, as set out on our pricing page or as otherwise agreed in writing. Buyers pay nothing to use Celby. Celby does not charge commission, and vendors selling through Celby do not pay buyer's-agent commission.
Acceptable use
You agree not to misuse the site — including posting false or misleading information, harvesting other users' contact details, or using the platform for anything unlawful. We may remove content or restrict access where these terms are breached.
Intellectual property
The Celby name, brand, website design and templates belong to Celby. Photos and content supplied by owners remain theirs; by listing, owners give Celby permission to display that content to market their property.
Liability
To the maximum extent permitted by law, Celby is not liable for any loss arising from the sale or purchase of a property listed on the platform, or from reliance on listing information. Nothing in these terms limits rights you may have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those apply.
Changes and law
We may update these terms from time to time; the current version always lives on this page. These terms are governed by New Zealand law.
